Terms and Conditions
1. These rules for the purchase and sale of goods (hereinafter referred to as the “Rules”) are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, the conditions for the purchase and payment for the goods, the procedure for the delivery and return of the goods, the liability of the parties and other provisions related to the purchase and sale of goods in the online store .
2. By placing an order, the Buyer confirms that he agrees with these Rules.
3. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a shopping cart in the online store, specified a delivery address, selected a payment method and familiarized himself with the Rules, clicks the “Buy” button.
Buyer’s rights and obligations.
1. The Buyer undertakes to pay the Seller the agreed amount for the ordered goods and to accept them.
2. Provide complete, detailed and correct information in the payment form. If the Buyer provides inaccurate, false or misleading data in the payment form, has the right to cancel the Buyer’s registration and delete the data.
3. If the Buyer’s data provided in the purchase form changes, the Buyer must immediately inform the Seller.
4. The Buyer has the right to withdraw from the purchase and sale agreement, in accordance with the provisions set out in the Product Return Rules.
5. By placing an order in the online store , the Buyer agrees to these Purchase and Sale Rules and undertakes to comply with them and the legal acts of the Republic of Lithuania.
Seller’s rights and obligations.
1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store .
2. If the Buyer tries to undermine the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without warning limit, suspend or terminate the Buyer’s ability to use the online store.
3. The Seller undertakes to respect the Buyer’s right to privacy to the Buyer’s personal information specified in the purchase form and not to transfer it to third parties.
4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. In the event of important circumstances, the Seller may temporarily or completely terminate the operation of the online store without prior notice to the Buyer.
6. The Seller may unilaterally change the terms of these Rules.
7. If the Buyer uses the services provided by after these terms and conditions have been changed, it is considered that the Buyer has agreed to the change in the Rules.
Ordering goods, prices, payment procedure, terms.
1. The Buyer can make purchases online in the online store 7 days a week, 24 hours a day.
2. All prices for goods in the online store are indicated in euros, including VAT.
3. The Buyer undertakes to pay for the order within 3 (three) calendar days from the date of order confirmation. The shipment begins to be prepared only after receiving payment for the goods.
4. If the Buyer fails to make payment within 3 (three) calendar days, the order is canceled.
5. Payment can be made using Visa / MasterCard payment cards. Payments are possible in euros.
Personal data protection.
1. When ordering goods in the online store , the buyer must provide the data requested during the purchase: name, surname, address and email address.
2. The buyer is responsible for providing correct data during the purchase.
3. By placing an order, the buyer agrees that the personal data provided by him will be processed for the purposes of executing the order. The buyer also agrees that information messages necessary for executing the order of goods will be sent to the e-mail address specified by the buyer.
4. The buyer’s personal data may be processed for marketing purposes only if the buyer himself expresses his consent to this.
5. The seller undertakes not to disclose the buyer’s personal data to third parties, except when required by a competent state institution in cases provided for by the laws of the Republic of Lithuania or with the separate written consent of the buyer.
Delivery of goods.
1. When purchasing goods in the online store , the Buyer may choose the method of delivery of goods: delivery service.
2. Delivery service of goods:
2.1. The Buyer, having chosen the delivery service of goods, undertakes to provide the exact delivery address of the goods;
2.2. The Buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer does not have the right to make claims to the Seller regarding the delivery of goods to an inappropriate entity;
2.3. the goods may be delivered by the Seller himself or by his authorized representative.
3. The Seller is exempted from liability for violation of the terms of delivery of goods if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances dependent on the Buyer.
4. Upon receipt of the goods, the Buyer must, together with the Seller or his authorized representative, check the condition of the shipment and the goods(s) and sign the invoice, waybill or other document of transfer and acceptance of the shipment. Once the Buyer signs the invoice, waybill or other document of transfer and acceptance of the shipment, it is considered that the shipment has been transferred in proper condition, there are no damages to the goods, the cause of which is not attributable to a manufacturing defect, and there are no discrepancies in the configuration of the goods(s) (such as can be determined by inspecting the exterior of the goods). Having noticed that the packaging of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the goods (-s) are damaged and (-s) the goods (-s) are not properly assembled, the Buyer must note this on the invoice, waybill or other document of transfer and acceptance of the shipment and, in the presence of the Seller or his representative, draw up a free-form act of damage (non-conformity) of the shipment and (-s) of the goods (-s). If the Buyer fails to perform these actions, the Seller is released from liability to the Buyer for damage to the goods, if the basis for such damage is not a manufacturing defect, and for non-conformity of the goods, if these non-conformities can be determined by inspecting the exterior of the goods.
5. The characteristics of all goods sold are indicated in the description attached to each item. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer.
Return of Goods.
1. Defects in the sold goods are eliminated, poor-quality goods are replaced, returned in accordance with the Rules for Return and Exchange of Goods approved by the Minister of Economy Order No. 4-959 of 23 December 2011 “On Approval of the Rules for Return and Exchange of Goods”.
2. In order to return the goods(s), in accordance with clause 11.1, the Buyer must notify the Seller by e-mail: info@horasoee.eu The Seller will send a document for returning goods, which the Buyer must fill out and submit to the Seller together with the returned Goods.
3. When returning goods, the following conditions must be met:
3.1. the returned goods must be in their original, neat packaging (this clause does not apply in the case of a poor-quality goods being returned);
3.2. the goods must not have been damaged by the Buyer;
3.3. the product must be unused, not lost its commercial appearance (label not damaged, protective film not torn, etc.) (this point does not apply in the case of returning a poor-quality product);
3.4. the returned product must be in the same configuration as the Buyer received it;
3.5. when returning the product, it is necessary to provide a document of its acquisition;
3.6. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods were not met;
3.7. The return of the goods is carried out in the manner chosen by the Buyer;
3.8. The Buyer bears the costs of returning the goods, except in cases where the product is defective.
4. money for the returned goods is returned only by bank transfer to the payer’s bank account within 14 days from the moment of receipt of the returned Goods. The money paid for the initial delivery of the goods to the Buyer is not refundable. The Seller is not responsible for any delay or failure to make a payment for the returned goods if the Buyer incorrectly provides or does not provide the data required for the return.
Final provisions.
1. reserves the right to suspend, supplement, amend these Rules and other documents related to the Rules at its discretion. Additions or amendments to the Rules shall enter into force from the date of their publication.
2. If the Buyer does not agree with the new version of the Rules, partial additions, amendments, the Buyer has the right to refuse them, provided that the Buyer loses the right to use the services of the online store.
3. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.
4. The law of the Republic of Lithuania shall apply to relations arising on the basis of these Rules.
5. All disagreements arising from the implementation of these Rules shall be resolved by negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
6. The Parties are released from the implementation of their obligations under these Rules if their implementation is impossible due to force majeure circumstances.
